Terms & Conditions

These terms govern your use of the PTW Solutions website and the PermitPro software. Please read them carefully.

1. Introduction

These Terms and Conditions ("Terms") are between you and PTW Solutions ("PTW Solutions", "we", "us", "our"), based in Dunfermline, Scotland, United Kingdom. They apply to:

  • the website at https://ptwsolutions.com (the "Website"); and
  • the PermitPro electronic permit-to-work software, including the web portal and the iOS and Android mobile apps ("PermitPro").

By using the Website or PermitPro you agree to these Terms. If you do not agree, please do not use them.

Business customers. Where your organisation has signed a separate subscription agreement, order form, or master services agreement with PTW Solutions, that agreement takes priority over these Terms if there is any conflict.

2. Using the Website

The Website is provided for information about our services. You may browse it and contact us through it. You must not:

  • use the Website in any way that breaks the law;
  • attempt to gain unauthorised access to any part of the Website, its administration area, or the systems that host it;
  • introduce viruses or other harmful code;
  • scrape, copy, or republish content without our written permission.

We try to keep the Website accurate and up to date, but it is provided "as is" and we do not guarantee that it is free of errors or always available.

3. Access to PermitPro

3.1 Accounts

PermitPro is a business tool. Access is granted by the customer organisation that holds the subscription (your employer, the site operator, or a principal contractor). Your organisation's administrator creates your account and assigns your role, such as Coordinator, Approver, or Permit Requester.

3.2 Your responsibilities

  • Keep your login details confidential and do not share your account.
  • Tell your administrator immediately if you believe your account has been compromised.
  • Only sign, approve, or revalidate a permit when you are authorised to do so and have carried out the checks the permit requires.
  • Make sure the information, photos, and documents you enter are accurate and truthful.
  • Follow your organisation's permit-to-work procedures and all applicable health and safety law.

3.3 Electronic signatures

When you draw your signature in PermitPro and apply it to a permit, you are making the same commitment as signing a paper permit. Signatures and the date and time of each action are recorded as part of the permit audit trail and cannot be altered afterwards.

3.4 Acceptable use

You must not:

  • use PermitPro for any purpose other than managing permits and related safety records for your organisation;
  • reverse engineer, decompile, or attempt to extract the source code of PermitPro;
  • interfere with the security or operation of PermitPro;
  • upload content that is unlawful, offensive, or infringes another person's rights.

4. PermitPro and safety responsibility

Important. PermitPro is a tool that records and coordinates the permit-to-work process. It does not replace risk assessment, competent supervision, isolation checks, or any other safety control. Responsibility for the safety of work on site remains with the organisations and individuals carrying out and authorising that work.

PermitPro depends on the accuracy of the information users enter and on the availability of the user's device and network connection. Your organisation should maintain a fallback procedure, such as paper permits, for use when PermitPro cannot be accessed.

5. Subscriptions and payment

PermitPro is licensed to customer organisations under a subscription based on the number of users and permits, as described on our pricing section or in a written quote. Prices are quoted on application. Fees, payment terms, the subscription period, and renewal or cancellation terms are set out in the customer's subscription agreement or invoice. Individual users are not charged for using PermitPro.

6. Your data and content

Permit records, photos, documents, and signatures entered into PermitPro ("Customer Data") belong to the customer organisation. You grant PTW Solutions a licence to host, process, back up, and display Customer Data as needed to provide PermitPro and support the customer. We process personal data as described in our Privacy Policy.

On request at the end of a subscription we will provide the customer organisation with an export of its Customer Data in a reasonable format, after which we may delete it in line with our retention practices.

7. Intellectual property

PermitPro, the Website, and all associated software, designs, text, graphics, logos, and documentation are owned by PTW Solutions or its licensors and are protected by copyright and other intellectual property laws. "PTW Solutions" and "PermitPro" are our trading names and marks. Nothing in these Terms transfers ownership to you. You receive only a limited, non-exclusive, non-transferable right to use PermitPro in line with these Terms and your organisation's subscription.

8. Availability, support, and changes

We aim to keep PermitPro available at all times, but we do not guarantee uninterrupted access. We may suspend access for maintenance, security reasons, or events outside our control. We may update or improve PermitPro from time to time, and we may require you to install the latest version of the mobile app to continue using it. Support is provided to customer organisations as described in their subscription agreement.

9. Mobile app terms

The PermitPro mobile app is downloaded from the Apple App Store or Google Play. Your use of the app is also subject to the terms of the relevant store. Apple and Google are not parties to these Terms and have no obligation to provide maintenance or support for the app. The app needs an internet connection to sync permits, and may ask for camera and photo library permissions, which you can decline or revoke in your device settings.

10. Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that:

  • the Website and PermitPro are provided "as is" and we exclude all implied warranties to the extent permitted by law;
  • we are not liable for any loss arising from inaccurate information entered by users, from a user acting outside their authority, or from a failure to follow the permit-to-work process;
  • we are not liable for indirect or consequential loss, loss of profit, loss of business, or business interruption;
  • our total liability to a customer organisation in any twelve-month period is limited to the fees paid by that organisation for PermitPro in that period, unless a subscription agreement says otherwise.

11. Suspension and termination

We may suspend or end your access to PermitPro if you breach these Terms, if your organisation asks us to, or if your organisation's subscription ends. Your organisation's administrator may also deactivate your account at any time. Sections 4, 6, 7, 10, and 13 continue to apply after termination.

12. Changes to these Terms

We may update these Terms from time to time. The date at the top of this page shows when they were last changed. Continued use of the Website or PermitPro after a change means you accept the updated Terms. For material changes affecting PermitPro we will notify customer organisations in advance.

13. Governing law

These Terms are governed by the law of Scotland. The Scottish courts have exclusive jurisdiction over any dispute arising from them, except that we may enforce our rights in any court with jurisdiction.
